(MPASA)
Introduction
This site ("the
Site") is owned and operated by MPASA
Many areas of this Site are accessible
to all visitors but certain areas have restricted access for members of MPASA
only.
MPASA reserves the right to suspend or terminate your access and use of
this Site, with or without notice.
All intellectual
property rights in the Site and its content, including but not limited to
trademarks, data software, source code, databases, text, graphics, icons,
hyperlinks, private information, and designs are the property of or licensed to
MPASA, and are protected from unauthorised use and/or infringement.
All rights not
expressly granted are reserved.
The intellectual
property rights in all content, information, services and/or software vesting in
MPASA shall continue to vest in MPASA or such other third party as the case may
be and no right, title or interest in any proprietary material or information
contained in this Site is granted to you.
Use of Site

MPASA hereby grants
permission to any person to view the Site, and copy, print and use any document
and images presented on the Site, subject to the following conditions:
- The documents and images may be used solely for information and
noncommercial purposes only and will not be copied or posted on any network
computer or broadcast in any media,
- Copying for sale or public distribution of any material on this Site is
strictly prohibited,
- No modifications of documents as contained on this Site are permitted.
- The documents and images may be used solely for individual purposes and may
not be used to commercialise any products or services other than MPASA's
products and services;
Apart from the
manner set out above, you do not have permission to reproduce, modify or
commercially exploit IN ANY WAY any of the content obtained from the Site. If
you wish to republish or redistribute any of the content contained in the Site,
MPASA will discuss the terms of a commercial licence with you.

process or service does not constitute or imply an endorsement by MPASA of the

not necessarily state or reflect those of MPASA.
There may be links
to other sites from this Site; however, these other sites are not controlled by
MPASA and MPASA is not responsible for any content contained on any such site or
any loss suffered by the user in relation to his/her use of any linked site.
MPASA is hereby indemnified against any claims whatsoever regarding the
inclusion of links to outside sites or the user's use of those sites.
Liability
Any content provided
on this Site by outside parties is provided on the basis that MPASA disclaims
all warranties regarding all such content, whether expressed or implied.
MPASA makes no
representations or warranties of any kind, express or implied, as to the
operation of the Site, the information, content, materials or products included
on the Site.
MPASA's directors or
employees accept no liability whatsoever and take no responsibility for any loss
or damage which a user of the Site or any other third party may suffer or incur
as a result of the use of or reliance on material found on the Site, and,
without limiting the generality of the aforesaid, in particular for:
- Any errors, omissions, or inaccuracy of information or data on the Site,
- Any incompleteness in the information or data on the Site,
- Any interpretations or opinions stated in, or which may be inferred from
information on the Site.
The user agrees that
the use of this Site will be at his or her own risk. Neither MPASA, nor any of
its employees, agents and content providers, warrant that there will be
uninterrupted or error free use of this Site; nor do they make any warranty as
to the results that may be obtained from the use of this Site, or as to the
accuracy or reliability of any information, service or merchandise provided
through the Site.
Under no
circumstances shall MPASA be liable for any damages of whatsoever nature,
including injury caused by any failure of performance or error, omission or
inaccuracy, interruption, deletion, defect, delay in operation or transmission,
computer virus, communication line failure, theft or destruction or unauthorized
access to, alteration of or use of this Site, breach of contract, negligence, or
under any other cause of action.
The user
specifically acknowledges that MPASA is not liable for defamatory, offensive or
illegal conduct of other users or third parties and that the risk of injury or
any losses from the foregoing rests entirely with the user.
MPASA shall not be
liable for special, indirect, consequential, or incidental damages or damages
for loss of profits, loss of revenue, loss of data or loss of use arising out of
or related to the Site or the information contained in it, whether such damages
arise in contract, delict, statutory provision, law or otherwise.
Technical
disruptions
Disruptions caused
by technical errors, viruses or other disabling phenomena are aimed to be kept
to a minimum. "Technical disruption" means distribution of unsolicited
advertising or chain letters, propagation of computer worms, viruses or other
harmful code, and/or use of the Site to gain unauthorised entry to any hardware
item accessible via the Site. The possibility does exist, however, that some
data or information on this Site may have been created or structured in files or
formats that are not error free and we cannot guarantee that this will not
impact on the Site. MPASA does not accept any responsibility for any problems
you may encounter as a result of using this Site or any linked external sites.
Choice of
Law and Jurisdiction
These terms are to
be governed by and construed according to South African law and the parties
agree to submit any disputes to the jurisdiction of the South African courts.
